The Demise of the 28-Article Peace Proposal for Ukraine: Why Peace Negotiations Continue to Falter

Europe breathed a deep collective sigh of relief on Monday, as the diplomatic emergency sparked by the presentation of a new 28-point plan for resolving the conflict appeared – momentarily – to have been contained. A American diplomat spoke of "notable headway" after bilateral negotiations in Geneva. On Monday night, Moscow made its retaliation: a renewed assault of aerial bombardment on Kyiv.

The Pattern of Negotiation and Warfare

The chain of opposing developments captured the bleak nature of the recent timeframe. By day, political struggles are conducted: positive announcements are delivered from multiple capitals. Considerable effort is devoted on restraining certain initiatives. By night, Moscow clearly shows the world that, for them, military action persists as the main instrument for achieving "resolution".

After-Dark Attacks

As military strikes developed into the early hours of Tuesday, the present situation of Ukraine's exposure was laid bare. Ukraine is capable of detecting projectile deployments from across the border, a ability enabled by current data. From witness perspectives, Ukrainian air force fighter jets that had been scrambled to intercept incoming cruise missiles streaked across the sky – sophisticated military planes delivered to Ukraine by Western partners.

Soon thereafter, Kyiv's anti-aircraft weapons thundered: several firings targeted at a Russian ballistic missile. This was a sophisticated defense system at work, most likely delivered by Western nations. Every deployment creates sudden vibrations, causing tremors. The brief panic quickly gives way to resigned acknowledgment: possibly the hostile projectile won't hit its mark this time, protecting urban areas from devastation and additional electricity failures.

Continuous Dangers

Soon after, a automatic firearm opened up on a aerial vehicle in the vicinity, part of a mobile-fire group – most likely Western-made equipment. Unfortunately, the bullets missed the enemy aircraft – it maintained course toward its destination.

With pauses, this carried on until dawn. Kyiv greeted the morning news: multiple fatalities, devastation and utility failures in numerous residences as a result of the evening attack. As customarily, everyone still maintained normal activities – living the war. But those entire period encapsulated Ukraine's vital need on external assistance – a reliance that neighboring countries are demonstrably unable to replace in the near term.

Unsuccessful Negotiations

The detailed framework from US administration sparked intense emotion, controversy and serious worry – and briefly redirected concern from Ukraine's most significant graft case in years. Yet, we have seen this script before, after previous diplomatic encounters and international summits.

Every new proposal from Washington follows the identical sequence: a negotiation push against Ukraine, which Kyiv, with allied governments, manages to fend off. They contain the crisis but never actually win the battle. This pattern will, no doubt, persist.

Political Considerations

It is convenient to criticize specific actors of consistently pushing Russian terms. But that does not seem to be the complete picture. Washington works based on a principle familiar among seasoned negotiators: you cannot secure via talks what you have lost on the battlefield. The White House believes that it is impossible to compel Moscow to abandon the land that it presently holds in Ukraine's occupied territories.

The issue is that while accepting these circumstances, Washington does nothing to deter Moscow, through diplomacy or military means, from thinking that the status quo will not change more in its benefit in the months ahead.

Opposing Positions

Therefore, Moscow is convinced that duration works to their advantage – that Ukraine and its allies are nearing depletion. Their reason to accept conditions that does not give them the largest achievable advantage is almost completely absent. There may be numerous efforts to stop fighting, but they will continue as long as Russia's leader remains supremely confident in the conclusion.

On the contrary, Ukrainian leadership believes that Ukraine can still hold out, progressively conceding civilians and areas but averting a total frontline collapse until conditions improve in its benefit.

Present Conditions

Objectively, there are no actual prerequisites for a truce. Now, personal considerations are entering the equation: leadership ambitions to mediate resolution and obtain worldwide acknowledgment, and the government's dual difficulties – on one hand, not to distance important partners, and on the other, to unite the population around the flag against any initiative Kyiv finds unworkable, so that their priority does not switch to domestic problems. And although their objective will now be much harder after recent developments, it remains quite doubtful that this will change their overall approach.

These two forces are influencing discussions.

Summary and Prospects

It took a mere seven days to terminate the proposed articles of the current initiative. Assertive and inconsistent approach of the matter by US administration, pushback by Ukraine and the other European countries, along with soothing efforts of representatives, and finally, latest revelations, all did their job.

While new plans based on old ideas are imminent, Kyiv, London and other Western governments should arrive at a critical understanding: Ukraine and Europe will only be able to fend off political attacks from Washington that are founded on Moscow's terms and show particular unwillingness to change the course of events, if they stand together and enhance their military capacity at a much faster pace. If they do, neither external pressure nor military threats will be able to overcome them. In the meantime, Ukraine's capacity to repel nightly air assaults will, for the coming months, mainly require continued Western support.
